Welcome to BuzzTales.

These Terms & Conditions apply when you use the BuzzTales website or purchase products, digital resources, courses or other services from us.

BuzzTales is a New Zealand business trading online. By using our website or placing an order, you agree to these Terms.

Nothing in these Terms limits your rights under the New Zealand Consumer Guarantees Act 1993, Fair Trading Act 1986, or other applicable consumer law.

1. Orders, prices and payment

All prices on the BuzzTales website are in New Zealand dollars (NZD) and include GST unless otherwise stated.

Payment must be made in full at the time of purchase using one of the payment methods available at checkout.

An order is confirmed once payment has been successfully processed.

We may change our prices, products, bundles or availability at any time. Changes will not affect orders that have already been confirmed.

We take reasonable care to ensure product descriptions, prices and availability are accurate. If we discover an obvious error relating to your order, we will contact you as soon as possible.

2. Shipping and delivery

Shipping charges, rural delivery information and delivery limitations are set out in our Shipping, Returns & Refunds Policy.

For BuzzTales book orders, we aim to prepare and hand your order to our courier within one business day of your order being placed, Monday to Friday, excluding public holidays.

Delivery times after dispatch depend on the courier and your location.

For products purchased directly from BuzzTales, we are responsible for ensuring they are delivered within a reasonable time and in acceptable condition, as required by New Zealand consumer law.

3. Merchandise fulfilled by third-party partners

Some physical merchandise sold through the BuzzTales website may be produced or shipped by a third-party fulfilment partner.

These products may:

have different delivery times
arrive separately from other items in the same order
use different shipping methods

If you purchased the product through the BuzzTales website, BuzzTales remains your point of contact if something goes wrong.

Please contact info@buzztalesmusic.com and we will work with the fulfilment partner where necessary.

4. Purchases from other retailers

BuzzTales products may also be available from third-party retailers or distributors, including retailers supplied through IngramSpark.

If you purchase from another retailer, your purchase is made directly from that retailer.

That retailer is responsible for its own:

prices
shipping charges
delivery process
packaging
returns and refunds
customer service

BuzzTales does not control the printing, packaging, delivery or customer service provided by third-party retailers.

Any issue relating to an order placed with another retailer should be raised with that retailer.

5. Returns, refunds and faulty products

Detailed information is available in our Shipping, Returns & Refunds Policy.

BuzzTales does not offer refunds or exchanges simply because a customer changes their mind.

This does not affect your rights under New Zealand consumer law.

Products supplied by BuzzTales must be of acceptable quality, match their description and be fit for their intended purpose. Where the required consumer guarantees are not met, you may be entitled to a repair, replacement, refund or other remedy depending on the circumstances.

6. Digital products and educational resources

BuzzTales digital products may include:

downloadable resource and activity packs
eBooks
music and movement resources
printable materials
online courses
other digital learning materials

Purchasing a digital product gives you a limited licence to use the content. It does not transfer ownership of the copyright or other intellectual property.

Digital products cannot be returned simply because you change your mind once they have been supplied or accessed.

Digital products are also covered by New Zealand consumer protections. If a digital product is faulty, incomplete, cannot be accessed correctly or is significantly different from its description, please contact us so we can resolve the problem.

7. Digital resource licences

Unless a different licence is stated at the time of purchase:

Individual or teacher purchase
The purchaser may use and print the resource as many times as reasonably needed for their own household or classroom.

Early childhood centre or kindergarten purchase
A centre that purchases a resource may use it within that centre.

School use
A teacher may use a purchased resource within their own classroom.

Resources may not be copied, emailed, uploaded, shared or distributed for use by other teachers, classrooms, schools, centres or organisations unless BuzzTales has given permission or a broader licence has been purchased.

Schools wanting resources for multiple classrooms can contact info@buzztalesmusic.com to discuss a whole-school arrangement.

8. Courses and account access

Some BuzzTales courses or digital products may require an online account.

You are responsible for keeping your login information secure.

Course login details must not be shared with anyone who has not purchased or been authorised to access the course.

If a course has a specific access period, this will be stated at the time of purchase.

BuzzTales may update course or digital content from time to time.

We will not intentionally remove paid access that was promised at the time of purchase without providing an appropriate alternative or remedy.

9. Intellectual property

Unless otherwise stated, BuzzTales content is owned by, or used under licence by, BuzzTales.

This includes:

stories and written content
songs and recordings
illustrations and characters
videos
educational resources and worksheets
designs and logos
photographs
website content

Purchased material may only be used within the licence provided.

You may not reproduce, sell, distribute, publish, upload, alter or commercially use BuzzTales content without our written permission, except where permitted by law.

10. User accounts

Where an account is required, you agree to provide accurate and current information.

You are responsible for keeping your password and account details confidential.

We may suspend or restrict an account where we reasonably believe it is being used fraudulently, unlawfully or in serious breach of these Terms.

Where possible, we will contact you before taking action.

11. Website and product availability

We aim to keep the BuzzTales website available and information accurate, but we cannot guarantee that the website will always be uninterrupted or error-free.

From time to time we may:

update or maintain the website
change or discontinue products and services
temporarily remove content
correct errors

We will not accept orders for products we do not reasonably believe we can supply on the terms advertised. Online traders must provide clear and accurate information about important sale terms and product availability.

12. Educational information and outcomes

BuzzTales resources are designed to support learning, creativity, music, literacy and related educational experiences.

Individual children and learners may respond differently to the materials.

We do not guarantee a particular educational, developmental or learning result from using our books, music, courses or resources.

This does not limit any rights that apply under New Zealand consumer law.

13. Privacy

We take your privacy seriously.

Information collected through the BuzzTales website may be used to:

process and deliver orders
provide access to digital products and courses
communicate with customers
operate and improve our website and services

14. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

To the extent permitted by law, BuzzTales is not responsible for indirect or consequential loss arising from circumstances outside our reasonable control.

Nothing in this section limits your rights under the Consumer Guarantees Act, Fair Trading Act or other applicable law.

15. Changes to these Terms

We may update these Terms from time to time to reflect changes to our products, services, website or legal obligations.

The current version will be published on our website.

Changes apply from the date they are published and will not remove rights relating to purchases already made.

16. Governing law

These Terms are governed by the laws of New Zealand.

Any dispute relating to these Terms or a purchase from BuzzTales will be dealt with under New Zealand law.
